Appealing a Denial of Social Security Benefits
One of the most frustrating aspects to the Social Security benefits process is receiving a denial of benefits. A Texas disability lawyer can help applicants who have received a denial letter and can get applicants on the road to receiving the benefits they deserve. Understand that an initial denial letter is not the end of the process and the government provides applicants with an appeals process by which they can argue they are truly injured and in need of supplemental benefits and care.
The most important aspect to remember is that the appeal must take place within 60 days from receipt of the denial letter. If an applicant fails to commence the appeal within this time period, the application process begins again from Step 1 – which could result in the loss of back benefits. We encourage our clients to appeal as soon as possible in order to facilitate a more efficient and fastidious trek through the bureaucratic denial system.
The denial letter will arrive in the mail and will explain the appeals process. There are multiple levels of appeals and the initial appeal is known as a “reconsideration.” An applicant facing a denial must request a reconsideration first and, upon denial of the reconsideration, request a formal appeals hearing within the 60-day time limit.
The Social Security Administration (SSA) provides applicants with three methods by which to appeal their denial and a Texas disability lawyer can assist applicants in any of the appeals methods. Upon receipt of a denial letter, applicants can contact the SSA via telephone to make arrangements for appeals forms to be sent via U.S. Postal Service. Secondly, denied applicants can go to the local Social Security office to submit an appeal by hand. This method requires submission of a copy of the denial letter. Always ensure the representative hands you a signed and dated copy of the appeal form indicating a timely appeal. Lastly, applicants can appeal online. As always, print and retain any receipts or proof of appeal in case it is necessary to prove a timely appeal.
A Texas disability lawyer is experienced and educated in Social Security disability laws and you are encouraged to contact our office as soon as possible. Remember, it is vital to start your appeal quickly after receiving a denial letter. We look forward to helping you with your claim.
